John Campos and Chad Elie, payment processors indicted in the Black Friday action, may have had their original motion for dismissal of charges rejected (see previous InfoPowa reports) but that has not discouraged them from launching a fresh motion, details of which have now emerged.

When the duo again appear in court in March they hope to be permitted to present their case to the jury, arguing that poker is a game predominantly of skill and is therefore not an illegal game of chance. If such an argument is accepted - and it has been tried before with mixed results - the illegality of the charges falls away and they may walk free.

Legal Poker report that the two processors have filed a motion in limine seeking such an opportunity
